All puppies will be current on vaccinations and worming, as well as have dewclaws removed, at time of purchase. The puppy is guaranteed healthy at the time of purchase. The buyer has 72 hours (excluding weekends and holidays) from the time of purchase to have the puppy examined by his/her veterinarian for health problem(s). If the veterinarian finds any life-threatening problems the buyer may return the puppy back to Enriquez Kennel, with a letter from the veterinarian explaining the problem he/she found. Enriquez Kennel must be contacted within the 72-hour period after purchase and informed of any problems. The puppy, along with any items provided with the puppy, must be returned within 72 hours of purchase at the expense of the buyer. Enriquez Kennel will either refund the purchase price or return the dog to the buyer in well condition. Should the puppy die, Enriquez Kennel will be supplied with a veterinarians' statement of cause of death (at new owner's expense). If death is caused by accident or poisoning, purchase price will not be refunded. Enriquez Kennel will not be responsible for any veterinarian bills or other bills the owner may incur after the purchase of the dog.
Co-ownership is/is not (circle one) a condition of sale. Co-ownership shall remain in effect until the following conditions are satisfied: ,at which time the ownership papers will be signed over solely to the buyer by Enriquez Kennel. If a puppy is co-owned, all actions, behavior, liability, and expenses of the puppy are the responsibility of the co-owner who has physical custody of the puppy at the time. If puppy is solely owned by the buyer, Enriquez Kennel is not liable for any behavior or action of the puppy once it leaves physical custody of Enriquez Kennel.
All puppies carry a guarantee against "genetic" health defects and/or problems. This guarantee is against any inherited disorders that would shorten the normal life-span of said puppy. The puppy owner will be refunded only the purchase price and/or a replacement dog. It will be the choice of Enriquez Kennel, whether or not the original dog, in a replacement situation, shall be neutered and left with the owner or returned to Enriquez Kennel.
The dog will be registered with the Kennel name (Enriquez) in the registered name on the official registering papers.
Accepted registries are UKC, AKC CKC, ADBA, International and Rare Breed only, the puppy will not be registered with any other registry without written permission from Enriquez Kennel. Enriquez Kennel, upon violation of this provision, has the right to take the puppy back from the buyer with no compensation to the buyer.
The puppy is not to be bred before the age of two(2) years old. If the puppy is bred before the age requirement is met, all guarantees are void. The buyer agrees to breed the puppy to UKC and/or AKC registered dogs/bitches of equal or better quality. The owner agrees that they will NOT sell any puppies from their litters to pet shops or puppy brokers. The owner also agrees to breed bitches no more than every other heat. All breedings must be for betterment of the breed and following the UKC/AKC and/or Parent Club Breeder Code of Ethics. Under no circumstances shall buyer, successors or assignees, allow the puppy's papers or pedigree to be used to falsely register another dog within any dog or pet registry.
Buyer herewithin specifically grants Power of Attorney to Enriquez Kennel, to allow Enriquez Kennel in Buyer's name to claim the puppy who is the subject of this contract from any Animal Shelter, Humane Society, SPCA, or Animal Rescue facility, should the dog be held in any such place or facility. Buyer holds the sheltering authority, agency, or party harmless for turning over the dog to Enriquez Kennel.
The breeder reserves the right to inquire about and inspect the puppy's way of being kept. The puppy is never to be allowed to run loose. The puppy is never too be used for fighting. The owner agrees to socialize the puppy and make him/her a good representative of the breed when out in public. If Enriquez Kennel finds the dog in an unsanitary and/or in poor health condition, Enriquez Kennel has the right to take the puppy back from the owner with no compensation to the owner and registration papers returned at that time.
Enriquez Kennel is to be notified if the owner moves and sent the new address and phone#. If for any reason the buyer cannot keep this puppy, the buyer will contact Enriquez Kennel first, before selling, disposing of, or giving this animal away. If Enriquez Kennel does not take the puppy back, then this guarantee and agreement is to be transferred to the new owner and a copy sent to Enriquez Kennel with the new owners name ,address, and phone#.
Puppies, when introduced into new surroundings, are sometimes inclined to exhibit shyness and inactivity. In some instances they may refuse to eat. After becoming adapted to their new environment they will readily accept you as their new master and the food you offer. Your care and attention will aid in overcoming the shyness of the new quarters.
You as the new owner have a great responsibility to maintain your dogs emotional and physical well-being by:
Maintaining a sound feeding program.
Insuring continued health by regular veterinarian check-ups.
Maintaining proper immunization.
Providing proper exercise.
The responsibility, love, and care you give your dog will be returned many times in the years ahead
I, the buyer, have read and agree to the terms of this contract. I also understand that if I do not uphold my part of this contract, Enriquez Kennel has the right to take my puppy back at no compensation to me and I shall be liable to Enriquez Kennel for $10,000.00 in liquidated damages, plus all attorney fees and costs incurred to achieve a remedy or get the dog back to breeder.
Any deletions to this contract shall be lined out and initialed by both parties, additional amendments will be noted on the back of this sheet followed by the signature of both parties
A $200.00 non-refundable deposit is required should the buyer change his/her mind or return the puppy for any other reason than those mentioned above. Payment of puppy is to be paid in full at time of shipping or pick up by new owner. Shipping, crate, and health certificates are to be paid by new owner.
I agree not to use this animal for any inhumane, immoral, or illegal purposes, I agree to this contract and agree to abide to it by my signature below.
